PARTICIPATION IN FOUR SISTERS – DISC GOLF ACTIVITIES ENTAILS UNKNOWN AND UNANTICIPATED RISKS THAT COULD RESULT IN PHYSICAL AND/OR MEOTIONAL INJURY, ILLNESS, DEATH OR DAMAGES TO YOUR SELF AND/OR TO OTHERS. RISKS MAY INCLUDE, BUT ARE NOT LIMITED TO, SLIPPING, MUD, WATER HAZARDS, UNEVEN GROUND, GOPHER HOLES, COW POO, BARBED WIRE FENCING, RAIL FENCING, ELECTRICAL FENCING, TREES, THORNE BUSHES/BRUSH, WILD LIFE, FARM ANIMALS, FIXED OBJECTS AND/OR OTHER PEOPLE WHICH MAY RESULT IN SPRAINS, FRACTURES, BREAKS, SCRAPES, BRUISES, DISLOCATIONS AND INJURIES TO HEAD, BACK OR NECK. THERE MAY ALSO BE A RISK OF DAMAGE AND/OR LOSS TO PERSONAL PROPERTY THAT INCLUDES BUT IS NOT LIMITED TO SUCH AS CLOTHING, CELL PHONES, FOOT WEAR, ACCESSORIES. In consideration of the services provided by FOUR SISTERS – DISC GOLF, I the participate am fully aware and am voluntarily participating in these activities. I, THE ABOVE NAMED INDIVIDUAL OF PLAY #1, on behalf of myself, my spouse, my child(ren), or the group that is in attendance, hereby will be known as the representative. FOUR SISTERS -DISC GOLF will also represent FOUR SISTERS FARMS and any affiliations to that name. I understand the following must be followed to ensure a safe and fun time for those who I represent; - Agree to all rules, regulations and safety measures in place at FOUR SISTERS – DISC GOLF. - Agree to use the designated area provided by FOUR SISTERS – DISC GOLF in a responsible manner. - Failure to follow the rules, regulations and safety measures will result in immediate removal from the property, right to use the property, without any right to refund of any payment made; and in the event of sickness, accident or injury, I authorize FOUR SISTERS – DISC GOLF employees and representatives to obtain, on my behalf, emergency treatment and to secure such medical treatment at my expense. - I agree to fully and forever waive, release and discharge from any and all claims, actions, cause of action, demands, judgements, damages (including compensatory, general, special, consequential, exemplary and punitive), liability or obligations of any nature or kind, whether known at the time I leave the property or which may arise or become known later, which accrue on account of, or in any way arise out of or in connection with: (a) my activities on the property (b) the activities on the property with others (c) the operations of FOUR SISTERS – DISC GOLF (d) my use of any and all of the property facilities, and (e) my use of any and all equipment on the property, whether owned by me, FOUR SISTERS – DISC GOLF, or a third party. - Agree to indemnify and hold FOUR SISTERS – DISC GOLF harmless from and against all losses, liabilities, claims, obligations, costs, damages, and/or expenses whatsoever, including, but not limited to, any and all attorneys’ fees, costs, damages, and/or judgement directly or indirectly arising out of, or relating to my acts or omissions while participating in any/all activities on the property. - Agree to accept and assume all of the risks which accompany the properties activities on the property that my participation in the activities is purely voluntary and I elect to participate in the activities notwithstanding the risks. - Fully understand that participating in the activities on the property involves physical exertion, and accordingly represent that I (a) am in sufficient good health to participate in activities on the property (b) I do not have any pre-existing physical or medical conditions, that may be impacted or worsened by my use of the property, and (c) will not use the property or the equipment while under the use of any drugs, alcohol or medication that may impair my physical abilities or judgement. - Certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in activities on the property, or if not, I agree to bear the cost of such injury, damage, or loss to myself and others. - I agree that any legal proceeding shall be filed solely in the province of Alberta and I further agree that the substantive law of Alberta shall apply in that action without regard to conflict of law or rules of that province. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF ANYONE IS HURT OR PROPERTY IS DAMAGED DURING MY PARTICIPATION IN THIS ACTIVITY, I MAY BE FOUND BY COURT OF LAW TO HAVE WAIVED MY RIGHT TO MAINTAIN A LAWSUIT OR COST AGAINSTFOUR SISTERS – DISC GOLF, FOUR SISTERS FARM, MARKET 817, FOUR SISTERS KITCHEN + TABLE, OR THE BEEKMAN FAMILY ON THE BASIS OF ANY CLAIM FROM WHICH I HAVE RELEASED THEM HEREIN. I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT AND AGREE TO BE BOUND BY ITS TERMS.
